Another of Morag’s insights was on the issues surrounding Dismissal From Work. This included cases that involved employees who were on Long Term Sick or who were whistle-blowers on their former place of employment.
It was very interesting to hear the different examples and see how appeals can be overturned and re-instated several times over, depending on which tier of the courts system heard the case.
She posed questions such as: Can gross negligence constitute gross misconduct? Can procedural flaws and failure to comply render a dismissal unfair?
Each of the cases Morag discussed were lengthy and had several intricate elements to them – making the employment tribunals far from straightforward.
As with every instance of dismissal, there are two sides to every story. Tribunal results certainly did not always go the way you might have imagined.
